Important Notice
This Founding Membership Addendum (the "Addendum") applies to eligible Founding and Founding Legacy memberships offered by Crown Control Pilates, operated by SK Pilates LLC (the "Studio," "Company," "we," "our," or "us").
This Addendum supplements the Crown Control Pilates Membership, Autopay and Purchase Agreement, Studio Policies, Client Waiver, and any purchase-specific terms presented at checkout. Except as expressly modified by this Addendum, all other terms of the Membership, Autopay and Purchase Agreement, Studio Policies, and Client Waiver remain in full force and effect.
By purchasing, electronically signing, checking an acceptance box, completing checkout, saving a payment method, booking, attending, or using a Founding Membership, the member or client ("Member," "Client," "you," or "your") acknowledges and agrees to this Addendum.
1. Eligible Founding Memberships
This Addendum applies only to the following membership types, if offered by the Studio during the founding release period: Founding 8, Founding 12, Founding Legacy 8, and Founding Legacy 12.
Specific pricing, class allowances, billing dates, benefits, guest pass allocations, welcome package benefits, and promotional details are as presented at the time of purchase or within the Studio app, website, booking platform, checkout page, or applicable purchase terms.
2. Founding Release Period
Founding Memberships are promotional membership offerings made available during the Studio's designated founding release period. The Studio may modify, suspend, discontinue, or withdraw Founding Membership offerings at any time before purchase.
Memberships purchased during the founding release period remain subject to the terms presented at purchase, this Addendum, the Membership, Autopay and Purchase Agreement, Studio Policies, Client Waiver, and any applicable purchase-specific terms.
3. Minimum Commitment Periods
Founding memberships require a minimum commitment period of three (3) consecutive months.
Founding Legacy memberships require a minimum commitment period of six (6) consecutive months.
The applicable commitment period begins on the date of the first successful membership billing unless otherwise stated at purchase.
4. Billing and Autopay
Founding Memberships are billed automatically on a recurring monthly basis using the payment method on file, in accordance with the Membership, Autopay and Purchase Agreement and any purchase-specific terms presented at checkout.
Member authorizes the Studio and its payment processor to charge recurring membership fees, monthly dues, late cancellation fees, no-show fees, additional class fees, unpaid balances, and any other authorized charges applicable to the membership.
5. Cancellation During Commitment Period
Founding Membership pricing, benefits, and privileges are offered in consideration of the applicable minimum commitment period. Accordingly, Founding Memberships may not be cancelled during the initial commitment period except where required by law or expressly approved by the Studio in writing.
The Studio may, in its sole discretion, consider requests for early termination arising from permanent medical incapacity that prevents participation in Studio services, relocation beyond a reasonable commuting distance from the Studio, or other extraordinary circumstances determined by the Studio on a case-by-case basis.
Supporting documentation may be required. Approval of any early termination request is not guaranteed and shall remain solely within the discretion of the Studio. Approval of one request shall not constitute a waiver of this policy or create an obligation to approve any other request.
6. Cancellation After Commitment Period
Upon completion of the applicable commitment period, Founding Memberships automatically continue on a month-to-month basis unless cancelled in accordance with the Membership, Autopay and Purchase Agreement and applicable membership terms.
Cancellation requests must be submitted through the cancellation method designated by the Studio and must comply with the applicable notice deadline in the Membership, Autopay and Purchase Agreement or purchase-specific terms. Membership fees already paid are non-refundable except where required by law or expressly stated in writing by the Studio.
Founding Membership pricing is reserved for active members in good standing. If a Founding Membership is cancelled, terminated, suspended for non-payment, or otherwise ends for any reason, the Member may not be eligible to re-enroll at the original founding rate or receive the same founding benefits. Any re-enrollment, reinstatement, pricing, or benefits will be subject to availability, Studio approval, and the membership terms in effect at the time of re-enrollment.
7. Membership Freeze
Founding Memberships are subject to the membership freeze provisions contained in the Membership, Autopay and Purchase Agreement and any applicable Studio criteria. A freeze does not automatically cancel a membership, and all other membership terms remain in effect unless otherwise approved by the Studio.
8. Founding Legacy Status
Founding Legacy Status is reserved for members enrolled in an eligible Founding Legacy membership during the founding release period.
Founding Legacy Status may include recognition, priority access to select promotions and events, enhanced welcome package benefits, guest pass benefits, or other benefits designated by the Studio. Such benefits may vary and are subject to availability, eligibility, and Studio discretion unless expressly stated otherwise in writing.
9. Guest Pass Benefits
Guest pass benefits vary by membership type and are provided only as stated at the time of purchase or in applicable purchase-specific terms.
Unless otherwise stated by the Studio, Founding 8 and Founding Legacy 8 memberships include one (1) complimentary guest pass during the applicable commitment period, and Founding 12 and Founding Legacy 12 memberships include one (1) guest pass per month during the applicable commitment period.
Guest passes have no cash value, are non-transferable, may not be sold, assigned, exchanged, shared, redeemed for cash, or applied as account credit, and must be used in accordance with Studio booking policies and guest eligibility requirements. Unused guest passes expire in accordance with the applicable membership or purchase terms and do not accumulate unless expressly stated by the Studio in writing.
10. Founding Welcome Package
Eligible Founding Memberships may include a Founding Welcome Package or Founding Legacy Welcome Package as advertised or presented at the time of purchase.
Welcome package items are subject to availability, have no cash value, may not be exchanged for cash or account credit, may not be transferred to another person, and may be substituted by the Studio with items of comparable value if necessary.
11. Priority Access to Select Promotions and Events
Eligible Founding Legacy members may receive priority access to select promotions and events as determined by the Studio.
Priority access opportunities are promotional in nature, may vary, are subject to availability, and are not guaranteed unless expressly stated in writing by the Studio.
12. Non-Transferability
Founding Memberships, Founding Legacy Status, class allowances, guest passes, welcome package benefits, promotional benefits, priority access privileges, and other membership benefits are personal to the Member and may not be transferred, assigned, shared, resold, exchanged, or redeemed for cash unless expressly permitted by the Studio in writing.
13. Relationship to Other Agreements
This Addendum supplements the Crown Control Pilates Membership, Autopay and Purchase Agreement, Studio Policies, Client Waiver, Privacy Policy, website/app terms, and applicable purchase-specific terms.
In the event of a conflict between this Addendum and the Membership, Autopay and Purchase Agreement, this Addendum shall govern only with respect to Founding Membership commitment periods, Founding Membership benefits, and Founding Legacy Status. All other terms of the Membership, Autopay and Purchase Agreement remain in effect.
14. Modification of Founding Offerings
The Studio may modify, discontinue, or replace future Founding Membership offerings, promotional benefits, or similar offers. Such changes will not affect benefits already earned or rights already granted under an active Founding Membership except where permitted by law or the applicable agreements.
15. Electronic Acceptance
Electronic signatures, checkbox acknowledgments, app-based acceptance, purchase completion, saved payment authorization, and other electronic records have the same legal force and effect as handwritten acceptance.
By purchasing, checking an acceptance box, electronically signing, saving a payment method, booking, or participating under a Founding Membership, Member acknowledges that Member has read, understood, and agrees to this Addendum.
